Eliminating the Waiting Lists for Certain MaineCare Services

 1 Emergency preamble. Whereas, acts and resolves of the Legislature do not
2 become effective until 90 days after adjournment unless enacted as emergencies; and
3 Whereas, persons with disabilities have the right to dignity and to receive the support
4 they need to work and to be otherwise included in their communities; and
5 Whereas, many persons with disabilities have an urgent need for adult home and
6 community-based services to provide support and to enable their family members to work;
7 and
8 Whereas, as of December 2019, more than 180 persons on the MaineCare Section 21
9 waiver waiting lists were receiving no services at all; and
10 Whereas, providing services for more MaineCare members eligible for Section 29
11 services ensures dignity and safety; and
12 Whereas, in the judgment of the Legislature, these facts create an emergency within
13 the meaning of the Constitution of Maine and require the following legislation as
14 immediately necessary for the preservation of the public peace, health and safety; now,
15 therefore,
16 Be it enacted by the People of the State of Maine as follows:
17 Sec. 1. Appropriations and allocations. The following appropriations and
18 allocations are made.

21 Initiative: Provides funding for one Social Services Program Specialist II position and 2 D
22 D Resources Coordinator positions.

11 Emergency clause. In view of the emergency cited in the preamble, this legislation
21
12 takes effect when approved.
22 SUMMARY
23 This bill:
24 1. Provides funding to clear the MaineCare Section 29 waiting list through the end of
25 fiscal year 2021; and
26 2. Provides funding to reduce waiting lists for MaineCare Section 21 services by
27 providing services to those individuals who are designated Priority 2 and are receiving no
28 other MaineCare home and community-based or support services.
