1 Be it enacted by the People of the State of Maine as follows:
2 Sec. 1. 17-A MRSA §1352, sub-§1, as amended by PL 1977, c. 671, §34, is further
3 amended to read:
4 1. The commission shall be Criminal Law Advisory Commission, referred to in this
5 chapter as "the commission," is composed of 9 members to be appointed by the Attorney
6 General. The members shall must be qualified by reason of their experience in the
7 prosecution or defense of criminal cases or by reason of their knowledge of the criminal
8 law. At least 2 members shall must be qualified by reason of their knowledge of juvenile
9 law. At least one member must be a law enforcement officer from a state law enforcement
10 agency and at least one member must be a law enforcement officer from a county or
11 municipal law enforcement agency. Members who are officers from a law enforcement
12 agency must have met the training requirements of Title 25, section 2804-C or equivalent
13 training in another state prior to appointment to the commission.
14 Sec. 2. 17-A MRSA §1358 is enacted to read:
15 §1358. Meeting notification
16 The chair of the commission shall provide written notice of each commission meeting
17 to every state, county and municipal law enforcement agency in the State.
18 Sec. 3. Transition for appointment of Criminal Law Advisory Commission
19 members. Notwithstanding the Maine Revised Statutes, Title 17-A, section 1352,
20 members of the Criminal Law Advisory Commission appointed by the Attorney General
21 serving on the effective date of this Act continue to serve until the completion of their
22 terms. Their successors are appointed as provided in Title 17-A, section 1352.
23 SUMMARY
24 This bill amends the membership of the Criminal Law Advisory Commission to require
25 that at least one member be a law enforcement officer from a state law enforcement agency
26 and at least one member be a law enforcement officer from a county or municipal law
27 enforcement agency. It also requires the chair of the commission to provide written notice
28 of each commission meeting to every state, county and municipal law enforcement agency
29 in the State.
