1 Be it enacted by the People of the State of Maine as follows:
2 Sec. 1. 17-A MRSA §1127 is enacted to read:
3 §1127. Maintaining drug-involved premises
4 1. A person is guilty of maintaining drug-involved premises if the person:
5 A. Knowingly opens, leases, rents, uses or maintains any place, whether permanently
6 or temporarily, for the purpose of unlawfully manufacturing, storing, distributing or
7 using a scheduled drug; or
8 B. Manages or controls, whether permanently or temporarily, either as an owner,
9 lessee, agent, employee, occupant or mortgagee, and knowingly and intentionally rents,
10 leases, profits from or makes available for use, with or without compensation, any place
11 for the purpose of unlawfully manufacturing, storing, distributing or using a scheduled
12 drug.
13 2. Maintaining drug-involved premises is a Class C crime.
14 SUMMARY
15 This bill creates the Class C crime of maintaining drug-involved premises, in which an
16 occupant, user or owner owns, rents, leases, occupies or otherwise uses a place for the
17 purpose of unlawfully manufacturing, storing, distributing or using a scheduled drug.
