1 Sec. 1. Workers' Compensation Board to study impact of workers'
2 compensation laws on certain public sector employees. Resolved: That the
3 Workers' Compensation Board shall study the fiscal impact of the implementation of the
4 Maine Revised Statutes, Title 39-A, sections 328, 328-A and 328-B and the rebuttable
5 presumption afforded certain employees in claims against municipalities for the past 20
6 years and devise a high-risk pool to protect municipalities from that impact; and be it
7 further
8 Sec. 2. Report. Resolved: That, by December 1, 2022, the Workers' Compensation
9 Board shall submit its report on the study under section 1 and suggested legislation to the
10 joint standing committee of the Legislature having jurisdiction over state and local
11 government matters. The joint standing committee of the Legislature having jurisdiction
12 over state and local government matters may report out legislation based upon the report
13 to the First Regular Session of the 131st Legislature.
14 SUMMARY
15 This resolve directs the Workers' Compensation Board to study the fiscal impact of
16 certain workers' compensation laws providing a rebuttable presumption that certain
17 employees received injuries in the course of their employment on municipalities and to
18 devise a high-risk pool to protect the municipalities from that impact.
