1 Be it enacted by the People of the State of Maine as follows:
2 Sec. 1. 24-A MRSA §2002-A, sub-§3, ¶D, as amended by PL 2011, c. 331, §2
3 and affected by §§16 and 17, is further amended to read:
4 D. Insurance on aircraft owned or operated by manufacturers of aircraft or of aircraft
5 operated in commercial interstate flight, or cargo of such aircraft, or against liability
6 other than workers' compensation and employer's liability arising out of the ownership,
7 maintenance or use of such aircraft; or
8 Sec. 2. 24-A MRSA §2002-A, sub-§3, ¶E, as enacted by PL 2011, c. 331, §2 and
9 affected by §§16 and 17, is amended by amending subparagraph (2) to read:
10 (2) The exempt commercial purchaser has subsequently requested in writing for
11 the producer to procure or place such insurance from a nonadmitted insurer.; or
12 Sec. 3. 24-A MRSA §2002-A, sub-§3, ¶F is enacted to read:
13 F. Insurance on commercial forestry and construction equipment, including but not
14 limited to feller bunchers, grapple skidders, delimbers, excavators, backhoes, front-end
15 loaders and backhoe loaders.
16 SUMMARY
17 This bill allows insurance producers with surplus lines authority to procure insurance
18 on commercial forestry and construction equipment from eligible surplus lines insurers
19 without adherence to the procedures set forth in the Maine Revised Statutes, Title 24-A,
20 section 2004.
