1 Be it enacted by the People of the State of Maine as follows:
2 Sec. 1. 35-A MRSA §1101, sub-§5 is enacted to read:
3 5. Additional considerations. Before issuing an order of authorization required under
4 this section that, if issued, would result in the ownership, in whole or in part, of a
5 transmission and distribution utility located in the State by a foreign government, a foreign
6 corporation or the subsidiary of a foreign corporation, the commission shall consider the
7 risks to national security and the potential economic losses within the State that may result
8 from such ownership.
9 SUMMARY
10 This bill requires the Public Utilities Commission to consider, before issuing an order
11 of authorization, the risks to national security and the potential economic losses in the State
12 associated with ownership, in whole or in part, of a transmission and distribution utility
13 located in the State by a foreign government, foreign corporation or subsidiary of a foreign
14 corporation.
