1 Be it enacted by the People of the State of Maine as follows:
2 Sec. 1. 22 MRSA §24, as enacted by PL 2017, c. 284, Pt. NNNNNNN, §7, is
3 amended to read:
4 §24. Photographs on electronic benefits transfer cards
5 The commissioner shall place a photograph of a recipient of benefits under a program
6 specified in section 22 on the recipient's electronic benefits transfer card if agreed to in
7 writing by the recipient. When a recipient of benefits is a minor or incapacitated individual,
8 the commissioner may place a photograph of the recipient's parent or legal guardian on the
9 EBT card if agreed to in writing by that parent or legal guardian.
10 SUMMARY
11 This bill removes the requirement that a recipient of an electronic benefits transfer card
12 must agree in writing for the Commissioner of Health and Human Services to place a
13 photograph of the recipient on the card.
