1 Emergency preamble. Whereas, acts and resolves of the Legislature do not
2 become effective until 90 days after adjournment unless enacted as emergencies; and
3 Whereas, this legislation must take effect to allow the reorganization of Prosecutorial
4 District Number 7 and the creation of Prosecutorial District Number 9 in time for the
5 November 8, 2022 election; and
6 Whereas, in the judgment of the Legislature, these facts create an emergency within
7 the meaning of the Constitution of Maine and require the following legislation as
8 immediately necessary for the preservation of the public peace, health and safety; now,
9 therefore,
10 Be it enacted by the People of the State of Maine as follows:
11 Sec. 1. 30-A MRSA §254, sub-§7, as enacted by PL 1987, c. 737, Pt. A, §2 and
12 Pt. C, §106 and amended by PL 1989, c. 6; c. 9, §2; and c. 104, Pt. C, §§8 and 10, is further
13 amended to read:
14 7. Prosecutorial District Number 7. There shall be is one district attorney for
15 Hancock and Washington Counties County, which shall is to be known as "Prosecutorial
16 District Number 7." The district attorney shall must be elected by the voters of Hancock
17 and Washington Counties County in the manner set forth in section 251.
18 Sec. 2. 30-A MRSA §254, sub-§9 is enacted to read:
19 9. Prosecutorial District Number 9. There is one district attorney for Washington
20 County, which is to be known as "Prosecutorial District Number 9." The district attorney
21 must be elected by the voters of Washington County in the manner set forth in section 251.
22 Emergency clause. In view of the emergency cited in the preamble, this legislation
23 takes effect when approved.
24 SUMMARY
25 This bill reduces Prosecutorial District Number 7 to Hancock County and creates
26 Prosecutorial District Number 9 for Washington County.
