Personal needs allowance for residents of nursing facilities. 2 Resolved: That, by January 1, 2020, the Department of Health and Human Services 3 shall amend the rules for the MaineCare program to increase the personal needs 4 allowance for persons residing in nursing facilities. The rules must provide for an 5 increase in the personal needs allowance from $40 per month to $70 per month. Rules 6 adopted pursuant to this section are routine technical rules as defined in the Maine 7 Revised Statutes, Title 5, chapter 375, subchapter 2-A.

8 Sec. 2. Personal needs allowance for residents of residential care 9 facilities. Resolved: That, by January 1, 2020, the Department of Health and Human 10 Services shall amend the rules for the MaineCare program to increase the personal needs 11 allowance for persons residing in residential care facilities. The rules must provide for an 12 increase in the personal needs allowance from $70 per month to $100 per month. Rules 13 adopted pursuant to this section are routine technical rules as defined in the Maine 14 Revised Statutes, Title 5, chapter 375, subchapter 2-A.

15 SUMMARY 16 This resolve directs the Department of Health and Human Services to amend its 17 MaineCare rules to provide for increases in the personal needs allowances of residents in 18 nursing facilities and residential care facilities. The rules are designated as routine 19 technical rules.
