A BILL ENTITLED
1 AN ACT concerning
2 University System of Maryland – Student Fees – Review and Retention
3 FOR the purpose of requiring the presidents of University System of Maryland institutions
4 to ensure that a student committee is presented with any proposed fees for their
5 review; requiring certain information to be provided to the student committee;
6 requiring certain revenues to be retained by a certain campus unit or department
7 unless the student committee approves an exception to the use of the fee; and
8 generally relating to fees at University System of Maryland institutions.

24 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND,
25 That the Laws of Maryland read as follows:
26 Article – Education

2 (a) (1) Except as provided in Subtitle 3 of this title, and subject to paragraph
3 (2) of this subsection, in consultation with the Chancellor and after a thorough search, the
4 Board of Regents shall appoint a qualified person as president of each constituent
5 institution.
6 (2) The Board of Regents shall approve the membership of any search
7 committee convened to recommend a qualified person as president of a constituent
8 institution.
9 (e) Subject to the authority and applicable regulations and policies of the Board
10 of Regents, each president shall:
11 (7) [Set] SUBJECT TO SUBSECTION (H) OF THIS SECTION, SET tuition
12 and fees;
13 (H) (1) (I) WHEN
SETTING MANDATORY AND NONMANDATORY
14 STUDENT FEES, THE PRESIDENT OF EACH CONSTITUENT INSTITUTION SHALL
15 ENSURE THAT THE PROPOSED FEES ARE PRESENTED TO A COMMITTEE OF
16 STUDENTS FOR REVIEW.
17 (II) THE INFORMATION PROVIDED TO THE COMMITTEE SHALL
18 INCLUDE:
19 1. THE AMOUNT OF THE FEE;
20 2. THE STUDENTS WHO WILL BE CHARGED THE FEE; AND
21 3. THE PROPOSED USE OF THE REVENUES GENERATED
22 FROM THE FEE.
23 (2) (I) EXCEPT AS PROVIDED IN SUBPARAGRAPH (II) OF THIS
24 PARAGRAPH, THE REVENUES DERIVED FROM MANDATORY AND NONMANDATORY
25 FEES, AS RECOMMENDED BY THE COMMITTEE OF STUDENTS THAT REVIEWED THE
26 FEE SHALL BE RETAINED BY THE CAMPUS UNIT OR DEPARTMENT THAT IMPOSED
27 THE FEE.
28 (II)
IF THE COMMITTEE OF STUDENTS THAT REVIEWED THE FEE
29 REVIEWS AN EXCEPTION TO THE USE OF THE FEE, A CAMPUS UNIT OR DEPARTMENT
30 MAY DIRECT THE USE OF THE FEE IN A MANNER BEYOND THE SUPPORT OF
31 OPERATIONS THAT ARE AVAILABLE AND FOR USE OF THE ENTIRE STUDENT BODY.

1 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July
2 1, 2021.
