A BILL ENTITLED
1 AN ACT concerning
2 Baltimore County – Board of Education – Oversight by the Baltimore County
3 Office of the Inspector General
4 FOR the purpose of providing that the Baltimore County Board of Education is subject to
5 the jurisdiction of the Baltimore County Office of the Inspector General; specifying
6 the matters for which the Baltimore County Office of the Inspector General may
7 receive and investigate complaints concerning the Baltimore County Board of
8 Education; requiring the Baltimore County Office of the Inspector General to provide
9 a certain report, on request, to certain entities; prohibiting certain entities from
10 requesting an investigation by the Baltimore County Office of the Inspector General;
11 and generally relating to oversight of the Baltimore County Board of Education.

17 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND,
18 That the Laws of Maryland read as follows:
19 Article – Education

21 (A) THE BALTIMORE COUNTY BOARD OF EDUCATION IS SUBJECT TO THE
22 JURISDICTION OF THE FOLLOWING INSPECTORS GENERAL FOR THE MATTERS
23 DESCRIBED IN SUBSECTION (B) OF THIS SECTION:
24 (1) THE OFFICE OF THE INSPECTOR GENERAL FOR EDUCATION

1 UNDER TITLE 9.10 OF THIS ARTICLE; AND
2 (2) THE BALTIMORE COUNTY OFFICE OF THE INSPECTOR GENERAL.
3 (B) THE BALTIMORE COUNTY OFFICE OF THE INSPECTOR GENERAL MAY
4 RECEIVE AND INVESTIGATE COMPLAINTS OR INFORMATION CONCERNING THE
5 BALTIMORE COUNTY BOARD OF EDUCATION REGARDING:
6 (1) INSTANCES OF FRAUD, WASTE, OR ABUSE INVOLVING THE USE OF
7 PUBLIC FUNDS AND PROPERTY;
8 (2) VIOLATIONS OF CIVIL RIGHTS, AS DEFINED IN FEDERAL OR STATE
9 LAWS, OF STUDENTS IN OR EMPLOYEES OF THE BALTIMORE COUNTY PUBLIC
10 SCHOOL SYSTEM; AND
11 (3) COMPLIANCE WITH OTHER APPLICABLE FEDERAL AND STATE
12 LAWS.
13 (C) (1) THE BALTIMORE COUNTY OFFICE OF THE INSPECTOR GENERAL
14 SHALL PROVIDE THE REPORT OF AN INVESTIGATION TO ANY OF THE FOLLOWING
15 ENTITIES ON THEIR REQUEST:
16 (I) THE BALTIMORE COUNTY BOARD OF EDUCATION;
17 (II) THE BALTIMORE COUNTY COUNCIL;
18 (III) THE BALTIMORE COUNTY EXECUTIVE;
19 (IV) THE BALTIMORE COUNTY HOUSE DELEGATION TO THE
20 GENERAL ASSEMBLY; AND
21 (V) THE BALTIMORE COUNTY SENATE DELEGATION TO THE
22 GENERAL ASSEMBLY.
23 (2)AN ENTITY LISTED IN PARAGRAPH (1) OF THIS SUBSECTION MAY
24 NOT REQUEST AN INVESTIGATION BY THE BALTIMORE COUNTY OFFICE OF THE
25 INSPECTOR GENERAL UNDER THIS SECTION.
26 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
27 October 1, 2021.
