1 AN ACT concerning
2 Creation of a State Debt – Maryland Consolidated Capital Bond Loan of 2021,
3 and the Maryland Consolidated Capital Bond Loans of 2012, 2013, 2014, 2015,
4 2016, 2017, 2018, 2019, and 2020
5 FOR the purpose of authorizing the creation of a State Debt in the amount of One Billion,
6 One Hundred Seven Million, Four Hundred Twenty–Seven Thousand Dollars 1
7 ($1,107,427,000) One Billion, One Hundred and Six Million, Three Hundred Seventy
8 Thousand, Six Hundred Twenty Dollars ($1,006,370,620) ($1,106,370,620), the
9 proceeds to be used for certain necessary building, construction, demolition,
10 planning, renovation, conversion, replacement, and capital equipment purchases of
11 the State, for acquiring certain real estate in connection therewith, and for grants to
12 certain subdivisions and other organizations for certain development and
13 improvement purposes, subject to certain requirements that certain matching funds
14 be provided and expended by certain dates; providing generally for the issuance and
15 sale of bonds evidencing the loan; imposing a certain tax on all assessable property
16 in the State; requiring that certain grantees convey certain easements under certain
17 circumstances to the Maryland Historical Trust; providing that the proceeds of
18 certain loans must be expended or encumbered by a certain date; authorizing the
19 Board of Public Works, under certain circumstances, to approve certain
20 appropriations, notwithstanding certain technical differences; authorizing certain
21 unexpended appropriations in certain prior capital budgets and bond loans to be
22 expended for other public projects; altering certain requirements for certain
23 programs in certain prior capital budgets and bond loans; reducing prior
24 authorizations of State Debt; requiring that certain projects be constructed at certain
25 locations; adding, altering, and repealing certain requirements for certain

3 terminate before certain dates; authorizing premiums from the sale of State bonds
4 in certain fiscal years to be used for certain purposes under certain circumstances;
5 requiring the Comptroller to make certain transfers, adjustments, and
6 reconciliations; repealing certain Maryland Consolidated Capital Bond Loan
7 Preauthorization acts; specifying the use of certain project funds; providing funds for
8 certain grants and loans contingent on the enactment of another Act; providing for 1
9 the use of certain funds contingent on the failure of a certain bill; requiring the cont
10 Department of the Environment to notify the General Assembly prior to the
11 expenditure of certain appropriations; authorizing the creation of State Debt in
12 certain years to be used for certain purposes; providing for the intent of the General
13 Assembly; making certain technical corrections; providing for a delayed effective

17 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND,
18 That: 1

19 (1) The Board of Public Works may borrow money and incur indebtedness on
20 behalf of the State of Maryland through a State loan to be known as the Maryland
21 Consolidated Capital Bond Loan of 2021 in the total principal amount of $1,107,427,000
22 $1,006,370,620 $1,106,370,620. This loan shall be evidenced by the issuance, sale, and
23 delivery of State general obligation bonds authorized by a resolution of the Board of Public
24 Works and issued, sold, and delivered in accordance with §§ 8–117 through 8–124 and
25 8–131.2 of the State Finance and Procurement Article.
26 (2) The bonds to evidence this loan or installments of this loan may be sold as a
27 single issue of bonds under § 8–122 of the State Finance and Procurement Article.
28 (3) The cash proceeds of the sale of the bonds shall be paid to the Treasurer and
29 first shall be applied to the payment of the expenses of issuing, selling, and delivering the
30 bonds, unless funds for this purpose are otherwise provided, and then shall be credited on
31 the books of the Comptroller and expended on approval by the Board of Public Works, for
32 the following public purposes, including any applicable architects’ and engineers’ fees:

2 construct architectural upgrades at State–owned facilities to
