Harford County - Alcoholic Beverages - Gift Basket Permit
This bill establishes a gift basket permit in Harford County. The bill authorizes the
Harford County Board of License Commissioners to issue the permit to a person (1) whose
primary business is the sale and delivery of flowers; (2) whose business includes the sale
and delivery of gift baskets of flowers, food, or other items; and (3) who does not hold
another alcoholic beverages license or permit. The board is prohibited from issuing a
permit for use in conjunction with or on the premises of a chain store, supermarket, or
discount house. A permit holder may sell and deliver, to consumers of a legal drinking age
located in the county, gift baskets containing specified volumes of beer, wine, or liquor
products, purchased from a retail license holder. The permit holder must maintain records
and submit reports required by the board and is subject to specified alcohol awareness
training requirements. The annual permit fee is $100. The bill takes effect July 1, 2021.
Fiscal Summary
State Effect: None.
Local Effect: Harford County revenues increase to the extent gift basket permits are issued
under the bill. Harford County can monitor permits and adopt the required regulations with
existing resources.
Small Business Effect: Minimal overall, but potential meaningful impact for permit
holders able to sell gift baskets containing alcohol, as specified, under the bill.
Analysis
Bill Summary: The permit holder or an employee of the permit holder must (1) deliver
the gift basket containing alcoholic beverages and (2) require the person receiving a
delivery of a gift basket containing alcoholic beverages to display proof that the person is
at least 21 years old. An individual who delivers a gift basket containing alcoholic
beverages must be at least 21 years old. The related place of worship and school distance
requirements do not apply to the issuance of a gift basket permit.
The bill prohibits a permit holder’s annual sales from alcoholic beverages from exceeding
10% of the holder’s annual gross sales. The board must adopt regulations for gift basket
permits.
Local Fiscal Effect: Harford County revenues increase by $100 annually for each gift
basket permit issued. As the number of individuals that will seek to obtain a permit, as a
result of the bill, is unknown, any corresponding revenue increase cannot be reliably
estimated. Harford County can monitor permits and adopt the required regulations with
existing resources.
