Consumption in Damascus

This bill authorizes the Montgomery County Board of License Commissioners to issue a
refillable or nonrefillable container permit for draft beer to the holder of a Class H beer and
wine license if the licensed premises is in Damascus (12th election district). The bill also
makes conforming changes. The bill takes effect July 1, 2021.
Fiscal Summary
State Effect: None.
Local Effect: Montgomery County can issue the permits and handle any enforcement
activities with existing resources. Montgomery County revenues are not affected.
Small Business Effect: Minimal.
Analysis
Current Law: The board may issue a refillable or nonrefillable container permit for draft
beer to the holder of (1) a Class B beer and wine license; (2) a Class D beer and wine
license; or (3) a Class BD-BWL license. There is no annual license fee for a refillable or
nonrefillable container permit in Montgomery County.
Class H licenses generally authorize the license holder to sell alcoholic beverages at a hotel
or restaurant at the place described in the license for on-premises consumption. The
annual license fee is $400.
