Horse Racing - Maryland-Bred Race Fund - Advisory Committee Membership
and Registration of Horses
This bill increases the number of members on the Maryland-Bred Race Fund Advisory
Committee from five to six to include a member who is a member of and recommended by
the Maryland Thoroughbred Horsemen’s Association. The bill also expands the
circumstances under which a horse may be registered with the Maryland Horse Breeders
Association. The bill takes effect June 1, 2021.
Fiscal Summary
State Effect: Altering the appointment process of advisory committee members does not
affect governmental finances. Any expense reimbursements for advisory committee
members are assumed to be minimal and absorbable within existing budgeted resources.
Local Effect: None.
Small Business Effect: Minimal.
Analysis
Bill Summary: The bill adds an alternative condition that may be met in order for a horse
to be registered with the Maryland Horse Breeders Association. Specifically, the horse may
be eligible to be registered if – in cases where the horse’s dam dies, is permanently retired,
or is certified by a veterinarian as unable to be bred – the horse resided in the State for at
least six months after the horse was foaled. As for all other registrations, the horse must
also have been foaled in Maryland as shown by a foal certificate from the Jockey Club.
Current Law: The Maryland-Bred Race Fund Advisory Committee consists of
five members appointed by the Maryland Racing Commission (MRC), with the approval
of the Secretary of Labor, as follows:
 two members of the Maryland Horse Breeders Association, who are recommended
by that association;
 one recommended by the mile thoroughbred racing licensees;
 one recommended by the Maryland State Fair and Agricultural Society, Inc.; and
 one member of MRC, who is appointed by MRC.
The term of a member of the advisory committee is one year and begins on June 1. If the
Maryland Horse Breeders Association, the mile thoroughbred racing licensees, or the
Maryland State Fair and Agricultural Society, Inc., fail to recommend an individual to be
a member of the advisory committee by June 1, MRC, with the approval of the Secretary
of Labor, appoints the member.
Registration with the Maryland Horse Breeders Association
A horse may only be registered with the Maryland Horse Breeders Association if the horse
was foaled in Maryland, as shown by a foal certificate from the Jockey Club, and meets
one of four additional conditions: (1) the breeder of the horse has maintained a place of
abode in Maryland for more than nine months immediately before registration; (2) the
breeder of the horse keeps breeding stock continually in Maryland; (3) the horse was
conceived in Maryland during the previous season; or (4) the horse’s dam was sent to
Maryland to foal and after foaling was covered by a Maryland stallion during the season
of the horse’s birth.
