A BILL ENTITLED
1 AN ACT concerning
2 Crimes – Indecent Exposure – Definition
3 FOR the purpose of defining the term “indecent exposure” to establish that the offense of
4 indecent exposure prohibits a person from engaging in a certain act of masturbation
5 in public; and generally relating to the crime of indecent exposure.
6 BY repealing and reenacting, with amendments,

11 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND,
12 That the Laws of Maryland read as follows:
13 Article – Criminal Law
15 (A) IN THIS SECTION, “INDECENT EXPOSURE” INCLUDES ENGAGING IN AN
16 ACT OF MASTURBATION IN PUBLIC, WHETHER OR NOT THE PERSON’S GENITALIA
17 ARE EXPOSED.
18 (B) A person convicted of indecent exposure is guilty of a misdemeanor and is
19 subject to imprisonment not exceeding 3 years or a fine not exceeding $1,000 or both.
20 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
21 October 1, 2021.
