State Board of Pilots - Sunset Extension
This departmental bill extends the termination date for the State Board of Pilots by 10 years
to July 1, 2032.
Fiscal Summary
State Effect: General fund revenues and expenditures for the State Board of Pilots are
maintained beyond FY 2022.
Local Effect: None.
Small Business Effect: The Maryland Department of Labor (MDL) has determined that
this bill has minimal or no impact on small business (attached). The Department of
Legislative Services concurs with this assessment.
Analysis
Current Law/Background: Pilotage is the act of guiding a marine vessel by a person
who is licensed to conduct the ship into or out of port or through dangerous water. In
Maryland, pilotage is conducted by individuals who are licensed by the State Board of
Pilots (in MDL) and who are members of the Association of Maryland Pilots. The State
regulates pilotage while the association manages the day-to-day implementation of pilotage
services. Most vessel movements in the State occur between the Port of Baltimore and the
Chesapeake Bay entrance at Cape Henry, Virginia, or between the Port of Baltimore and
Chesapeake City. The board has approximately 70 licensees at any one time, with annual
revenues ranging from $15,000 to $30,000 and annual operating expenses of approximately
$4,600.
Maryland Program Evaluation Act
The State Board of Pilots is 1 of approximately 70 regulatory entities and activities subject
to evaluation under the Maryland Program Evaluation Act (MPEA). Entities subject to
MPEA may be evaluated by the Department of Legislative Services only as directed by
specified entities or by legislation. Most such entities are subject to termination, including
the board, which is scheduled to terminate July 1, 2022. Accordingly, the evaluation
process is better known as sunset review.
