The committee on Consumer Protection and Professional Licensure to
whom was referred the joint petition (accompanied by bill, House, No.
4001) of Alice Hanlon Peisch and Michael J. Barrett (by vote of the town)
that the town of Weston be authorized to grant a license for the sale of
wines and malt beverages at a food store in said town, reports
recommending that the accompanying bill (House, No. 4190) ought to
pass.

An Act authorizing the town of Weston to grant an additional license for the sale of wines at a
food store.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
of the same, as follows:
1 SECTION 1. Section 1 of Chapter 37 of the Acts of 2008 is hereby amended by striking
2 out the first paragraph, and inserting in place thereof the following paragraph:-
3 Section 1. Notwithstanding section 17 of chapter 138 of the General Laws, the licensing
4 authority of the town of Weston may grant up to 2 licenses for the sale of wines not to be drunk
5 on the premises under section 15 of said chapter 138 to food stores. Except as otherwise
6 provided herein, any such license issued hereunder shall be subject to all of said chapter 138
7 except said section 17.
8 SECTION 2. Said section 1 of said chapter 37 of the Acts of 2008 is hereby further
9 amended by striking out the third and fourth paragraphs, and inserting in place thereof the
10 following paragraphs:-
11 Notwithstanding any general or special rule or regulation to the contrary, the licensing
12 authority shall not approve the transfer of a license granted hereunder to any other location, but a

13 license may be granted at the same location if an applicant for such license files with the
14 authority a letter in writing from the department of revenue indicating that the license is in good
15 standing with the department and that all applicable taxes have been paid.
16 If a license granted under this section is canceled, revoked or no longer in use, it shall be
17 returned physically, with all of the legal rights, privileges, and restrictions pertaining thereto, to
18 the licensing authority which may then grant the license to a new applicant at the same location
19 and under the same conditions as specified in this section.
