whom was referred the petition (accompanied by bill, House, No. 3715) of
Danillo A. Sena, Michael P. Kushmerek and John J. Cronin (by vote of the
town) relative to authorizing the town of Lunenburg to grant an additional
license for the sale of all alcoholic beverages not to be drunk on the
premises to Jaxx Country Variety, reports recommending that the
accompanying bill (House, No. 3813) ought to pass.

An Act authorizing the town of Lunenburg to grant an additional license for the sale of all
alcoholic beverages not to be drunk on the premises to Jaxx Country Variety.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
of the same, as follows:
1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the
2 local licensing authority of the town of Lunenburg may grant an additional license for the sale of
3 all alcoholic beverages not to be drunk on the premises pursuant to section 15 of said chapter 138
4 to Genghis, Inc. d/b/a Jaxx Country Variety located at 1353 Massachusetts Avenue in the town
5 of Lunenburg, Massachusetts. The license shall be subject to all said chapter 138 except said
6 section 17.
7 (b) The licensing authority shall not approve the transfer of the license granted under this
8 act to any other location but it may grant the license to a new applicant at the same location if the
9 applicant files with the licensing authority a letter from the department of revenue and a letter
10 from the department of unemployment assistance indicating that the license is in good standing
11 with those departments and that all applicable taxes, fees and contributions have been paid.
12 (c) If a licensee terminates or fails to renew a license granted under this act or any
13 such license is cancelled, revoked or no longer in use, it shall be returned physically, with all of
14 the legal rights, privileges and restrictions pertaining thereto, to the licensing authority, and the

15 licensing authority may then grant the license to a new applicant at the same location under the
16 same conditions as specified in this act.
17 (d) All licenses granted under this act shall be issued within 1 year after the
18 effective date of this act; provided, however, that a license originally granted within that time
19 period may be granted to a new applicant under subsections (b) or (c) thereafter.

21 SECTION 2. This act shall take effect upon its passage.
