An Act to allow the town of Andover to transfer conservation land.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
of the same, as follows:
1 SECTION 1. Notwithstanding the provisions of any general or special law to the
2 contrary and pursuant to the provisions of article 97 of the amendments to the Constitution of the
3 Commonwealth of Massachusetts, the town of Andover select board is hereby authorized to
4 transfer a parcel of land, currently held for general municipal purposes, consisting of
5 approximately 7.419 acres, located at 126 Tewksbury Street, and recorded at Book 10031, Page
6 237 of the Essex North District Registry of Deeds, shown as Assessors Map 182, Parcel 7, to the
7 care, custody, and control of the Conservation Commission of the town of Andover, for
8 conservation and passive recreation purposes.
9 SECTION 2. In consideration for the transfer of the land as provided in section 1 of this
10 act, the Conservation Commission of the town of Andover shall transfer two parcels of land on
11 High Plain Road consisting of approximately 4.401 acres used as the Bald Hill composting
12 facility and approximately 0.677 acres used as a dog park and parking lot, both parcels being a
13 portion of the property described in a deed recorded at Book 1294, Page 232 and shown as Lot 1
1 of 2
14 and Lot 2 respectively on a plan on file at the Town Clerk’s Office titled “Plan of Land in
15 Andover, Mass. Prepared for Town of Andover, Date January 20, 2020” by Andover Consultants
16 Inc., to the care, custody, and control of the town of Andover select board on the conditions that
17 said composting facility shall remain as a composting facility only to be used for composting
18 organic material such as leaves, sticks, grass clippings, wood chips and the like, and said dog
19 park and parking lot shall remain as a dog park and parking lot and if the land transferred to the
20 care, custody, and control of the town of Andover select board ceases to be used as a composting
21 facility or dog park and parking lot, then that portion of the land which is not so used as a
22 composting facility or dog park and parking lot shall revert back to the Conservation
23 Commission of the town of Andover for conservation and passive recreation purposes.
24 SECTION 3. This act shall take effect upon passage.
