whom was referred the joint petition (accompanied by bill, House, No.
4234) of James Arciero and Edward J. Kennedy (by vote of the town) that
the town of Westford be authorized to grant two additional licenses for the
sale of all alcoholic beverages to be drunk on the premises in said town,
reports recommending the accompanying order (House, No. 4339) ought to
be adopted [Local Approval Received].

An Act authorizing the town of Westford to grant two additional licenses for the sale of alcoholic
beverages to be drunk on the premises.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
of the same, as follows:
1 SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, the
2 licensing authority of the town of Westford may grant 2 additional licenses for the sale of all
3 alcoholic beverages to be drunk on the premises under section 12 of said chapter 138 to
4 establishments located within the shopping center commonly known as the Westford Valley
5 Marketplace, located at 160-174 Littleton Road in the town of Westford, referred to hereafter as
6 the “Westford Valley Marketplace”. Licenses granted under this act shall be subject to all of
7 said chapter 138 except said section 17.
8 (b) A license granted under this act shall only be exercised in the dining room of a
9 common victualler and such other public rooms or areas as may be deemed reasonable and
10 appropriate by the licensing authority as certified in writing.
11 (c) The licensing authority shall not approve the transfer of a license granted under this
12 act to a location outside of the Westford Valley Marketplace but it may grant such a license to a
13 new applicant within the Westford Valley Marketplace if the applicant files with the licensing

14 authority a letter from the department of revenue and a letter from the department of
15 unemployment assistance indicating that the license is in good standing with those departments
16 and that all applicable taxes, fees and contributions have been paid.
17 (d) If a licensee terminates or fails to renew a license granted under this act or any such
18 license is cancelled, revoked or no longer in use, the license shall be returned physically, with all
19 of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority and the
20 licensing authority may then grant the license to a new applicant to be used at an establishment
21 located within the Westford Valley Marketplace under the same conditions as specified in this
22 act.
23 (e) The licenses granted under this act shall be issued within 1 year after the effective
24 date of this act; provided, however, that a license originally granted within that period may be
25 granted to a new applicant under subsections (c) or (d) thereafter.
26 SECTION 2. This act shall take effect upon its passage.
