Provides relative to the penalties for the crime of unauthorized use of a motor vehicle
Current law provides that a person convicted of the unauthorized use of a motor vehicle shall be fined not more than $5,000
or imprisoned with or without hard labor for not more than 2 years, or both.
Proposed law maintains present law and also provides that when the misappropriation or taking of a motor vehicle amounts
to less than a value of $1,000, the offender shall be imprisoned for not more than 6 months, or fined not more than $1,000,
or both.

EXPENDITURE EXPLANATION
There may be a decrease in SGF expenditures for the Department of Public Safety & Corrections - Corrections Services
(DPS&C), as well as local expenditures, to the extent a person is convicted of the unauthorized use of a motor vehicle, when
the value was less than $1,000. A conviction under the proposed law is a misdemeanor with a penalty of imprisonment for
not more than 6 months. To the extent the proposed legislation results in an average time served less than under current
law, there will be an indeterminable savings to both DPS&C and local jails. The decrease in expenditures depends on the
number of persons convicted, the minimum sentence an offender serves, and the cost per day for a local law enforcement
agency to incarcerate an offender.
There will be no change in the expenditures for the Department of Public Safety & Corrections - Corrections Services
(DPS&C) to the extent a person is convicted of the unauthorized use of a motor vehicle, where the value is greater than
$1,000, and sentenced to hard labor for up to 2 years. This penalty remains unchanged from current law.
For illustrative purposes, DPS&C currently has 450 offenders in custody for the unauthorized use of a motor vehicle. In
2021, there were 250 people convicted of this crime with an average sentence length of 2 years and there were 569
released with an average time served of 12 years.
REVENUE EXPLANATION
The proposed legislation may reduce local fund revenue to the extent that the fines assessed are lower than those prior to
the passage of this bill. Any potential revenue will accrue to the local governmental entities.
