Establishes a grant program to be administered by the office of broadband development and connectivity in the division of
administration
Proposed law creates the “Granting Unserved Municipalities Broadband Opportunities” (GUMBO) grant program. Proposed law establishes a
grant program to be administered by the office of broadband development and connectivity relative to grants for broadband expansion;
defines terms; establishes a procedure for application; allows public comment; allows protest; allows administrative and judicial review of
a protest decision; provides for consultation; conditions for the scoring process; requires fund matching; requirements for compliance;
failure to perform; provides for the receipt and disbursement of federal grant funds; requires reports; allows for an administration fee;
requires the legislative auditor to review the program and make recommendations to the office before implementation; provides for the
promulgation of rules; specific prohibitions on municipalities; reimbursements for grantees; and provides for related matters. Proposed
law provides specific provisions that all records related to GUMBO program shall be public records as provided by the Public Records Law
with certain exceptions. Effective upon the signature of the governor. Proposed law that grants solicited and awarded pursuant to the
GUMBO Program shall not be subject to the Louisiana Procurement Code or the Public Bid Law. The office shall devise and implement an
alternate procurement method.

EXPENDITURE EXPLANATION
Proposed law will result in an indeterminable expenditure impact for the Office of Broadband Development and Connectivity
to administer the Granting Unserved Municipalities Broadband Opportunities (GUMBO) program. Proposed law does not
provide for a recurring source of revenues for grant expenditures. The agency reports that the amount received by the state
or other sources will determine the potential increase in administrative expenditures.
NOTE: Act 119 (HB 1) currently provides an appropriation of $90 M from the Granting Unserved Municipalities Broadband
Opportunities Fund in the event that HB 642 of the 2021 RS is enacted into law.
NOTE: Proposed law provides that the office may use up to one percent of appropriated funds to administer the GUMBO
program. If HB 642 is enacted, 1% of the total grant appropriation would total $900,000 for administrative expenditures.
REVENUE EXPLANATION
There is no anticipated direct material effect on governmental revenues as a result of this measure.
