Creates a domestic violence fatality review team within the Louisiana Department of Health
Proposed law establishes the Louisiana Domestic Abuse Fatality Review (LDAFR) Panel within the Louisiana Department of
Health (LDH). Proposed law provides for membership on the review panel. Proposed law provides for functions of the
review panel, including the following: 1) identify the scope and nature of domestic abuse fatalities in the state; 2) research
trends, data, or patterns that are observed of domestic abuse fatalities; 3) review past events of domestic abuse fatalities by
reviewing records and other pertinent documents of public and private agencies responsible for investigating deaths or
treating victims; 4) implement rules related to cases reviewed, coordination among agencies and professionals involved, and
improvement of the data collection and record keeping of the causes of domestic violence fatalities; 5) make
recommendations of systematic improvements to promote serving victims of domestic abuse; and 6) recommend
components for prevention and education programs, and training to improve the investigation of domestic violence fatalities.

EXPENDITURE EXPLANATION
This bill creates the Louisiana Domestic Abuse Fatality Review Panel within the LA Department of Health (LDH). LDH
anticipates 1 additional full time program manager ($55,000 annual salary), 5 additional part time staff ($54,763 in part
time salaries), related benefits ($32,929), in addition to administrative expenses ($18,131) to provide support to the review
team. This estimate is based on resources and workload (data collection and analysis, reporting, and communications)
associated with an existing support function within LDH for conducting Mortality Surveillance reviews. The LFO cannot
corroborate that the workload will necessitate the resources estimated by LDH. To the extent these activities may be
performed with fewer personnel or resources, costs may decrease accordingly.
In addition, although it is not assumed that members serving on the review team will be paid a salary, there could be
additional costs associated with both travel and per diem reimbursement for the members. At least 20 members will serve
on the review team.
Note: Provisions of this Act shall not become effective unless and until sufficient funds are available through
non governmental sources or are specifically appropriated by the legislature.
REVENUE EXPLANATION
There is no anticipated direct material effect on governmental revenues as a result of this measure.

SUMMARY CONTINUED FROM PAGE ONE
Proposed law authorizes establishment of local and regional panels for assistance related to analyzing data from state
systems. Proposed law provides that the review panel may have access to medical and vital records in the custody of
physicians, hospitals, clinics, the office of public health, and any other pertinent information to perform its functions and
duties.
Proposed law authorizes the review panel or any local or regional panel to request from any person, agency, entity any
relevant information to carry out its functions and duties. Information requested includes medical information, mental
health information, information from elder abuse reports or investigation reports, information from child abuse reports,
summary of criminal history or criminal offender record, information pertaining to reports by healthcare providers of persons
suffering from physical injuries inflicted by means of a firearm, information concerning a juvenile court proceeding,
information maintained by a family court, information provided by probation officers, and records of in home supportive
services (unless otherwise prohibited). Proposed law provides for voluntary disclosure of certain information, and provides
that certain information shall be confidential. Proposed law limits review team members from disclosing certain information.
Proposed law provides that when the review panel concludes a review of domestic abuse fatality, the panel shall return all
information and records that concern a victim to the family, or agency that furnished the information.
Proposed law provides the review panel to issue an annual report of its findings to the governor, the speaker of the House of
Representatives, and the president of the Senate. The initial report shall be on or before January 30, 2023 and every year
thereafter. Proposed law provides that LDH may secure financial and human resources from, or create formal partnerships
with external entities in order to meet obligations under this measure.
