HB 365 2021 Regular Session Farnum
Present law establishes the commission, requires the commission be composed of 13
members, and provides various criteria for the members. Proposed law would have retained
present law.
Present law requires three members of the commission to be owners of racehorses which
participate in any race licensed by the commission. Proposed law would have retained
present law.
Proposed law would have required that one of the three owner-members be from the
Louisiana quarter horse industry.
Proposed law would have required certain monies from wagers placed at offtrack wagering
facilities on historical horse races to be distributed as follows:
(1) 70% allocated and provided to the licensed racing associations in the state which
conduct live horse racing on the basis of the proportion of the number of
thoroughbred race days each association conducted for the preceding year bears to
the total number of thoroughbred race days conducted statewide for the preceding
year, and such funds shall be used solely to supplement purses in accordance with a
schedule or formula established by the purse committee of the Louisiana
Thoroughbred Breeders Association on Louisiana-bred thoroughbred races.
(2) 30% allocated and provided to the licensed racing associations in the state which
conduct live quarter horse racing on the basis of the proportion of the number of
quarter horse race days each association conducted for the preceding year bears to the
total number of quarter horse race days conducted statewide for the preceding year,
and such funds shall be used solely to supplement purses in accordance with a
schedule or formula established by the purse committee of the Louisiana Quarter
Horse Breeders Association on Louisiana-bred quarter horse races.
Certain provisions of proposed law would have superseded certain provisions of proposed
law of the Act which originated as Senate Bill 209 of the 2021 Regular Session.

VETO MESSAGE:
"Please be advised that I have vetoed House Bill 365 of the 2021 Regular Session.
As originally introduced, House Bill 365 sought to require one of the three owner-members
of the Louisiana State Racing Commission to be from the Louisiana quarter horse industry.
The bill in its final form, however, additionally requires a percentage of the net commission
on wagers on historical horse races made at offtrack wagering facilities to be distributed to
supplement live horse racing purses. The bill allocates the money proportionately based on
the number of race days each association conducted in the preceding year, creating an
inequitable distribution."
