Provides relative to the rate at which certain prisoners earn "good time". (gov sig)
Present law provides for offenders convicted of a crime of violence, without a prior conviction of a crime of violence, or a sex
offense to earn “good time” at a rate of 1 day for every 3 days in actual custody, for those offenders who commit an offense
or whose probation or parole is revoked on or after November 1, 2017. Proposed law retains present law and clarifies the
language that an offender cannot have a prior conviction of a sex offense. Proposed law amends present law and allows
offenders who committed an offense or whose probation or parole was revoked prior to November 1, 2017, to earn “good
time” if certain conditions are met.

EXPENDITURE EXPLANATION
There will be an indeterminable decrease to SGF expenditures for the Department of Safety & Corrections - Corrections
Services (DPS&C) to the extent more offenders may be eligible to earn “good time” and are thereby released from custody
of DPS&C. Present law only applies to offenders convicted of a crime of violence who committed an offense or whose
probation or parole is revoked on or after November 17, 2017. Proposed law provides that offenders who committed an
offense or whose probation or parole was revoked prior to November 1, 2017, earn good time if certain conditions are met.
This limited retroactive applicability of “good time” for offenders convicted of a first offense crime of violence may result in
more offenders being released from the custody of DPS&C earlier than they normally would have been. A reduction of
offenders in DPS&C custody could save DPS&C $26.39 per day per offender and $9,632 annually ($26.39 per day per
offender x 365 days) for those in adult local housing. A reduction in convictions could save DPS&C $67.36 per day per
offender and $24,586 annually ($67.36 per day per offender x 365 days) for those in a state facility.
REVENUE EXPLANATION
There will be an indeterminable increase in self-generated revenue to the Department of Public Safety & Corrections - Adult
Probation and Parole (probation) to the extent offenders convicted of a first offense crime of violence are released on parole
and/or probation. The probation department would realize an increase in fees paid by parolees and probationers. The exact
fiscal impact is indeterminable because the number of offenders who may be released and the amount of monthly fees
charged is unknown.
