Provides relative to the financial security for surviving spouses and children of law enforcement officers who suffer death by
heart attack or stroke
Present law provides financial security for the surviving spouse and dependent children of firemen whose death is the direct
and proximate result of a heart attack or stroke shall be presumed to have died as the direct and proximate result of an
injury sustained in the performance of his official duties. Proposed law retains present law and adds applicability to law
enforcement officers, as defined by law.

EXPENDITURE EXPLANATION
There will be an increase in SGF expenditures of the Office of Risk Management (ORM) to the extent they pay survivor
benefits to the surviving spouse and/or dependent children of those law enforcement officers who die as a result of a heart
attack or stroke in the line of duty. The amount of survivor benefits paid is $250,000 to a surviving spouse and $25,000 to
surviving dependent children. The amount of benefits paid in each fiscal year is indeterminable; however, ORM reports 5
heart attack/stroke claims have been denied over the past 3 years, and there have been 2 - 5 heart attack/stroke inquiries
per year over the last 5 years. Therefore, ORM has projected 4 heart attack and/or stroke claims each year with a total SGF
expenditure increase of $1 M. ORM reports this amount may increase if there are dependent children.
Note: ORM receives an annual SGF appropriation to pay survivor benefits for law enforcement officers and firemen who die
in the course of duty. To the extent the proposed law is enacted, ORM will request an additional appropriation (as needed)
in future fiscal years in order to pay any additional claims that may be approved.
REVENUE EXPLANATION
There is no anticipated direct material effect on governmental revenues as a result of this measure.
