Provides relative to parole
Proposed legislation removes the prohibition that those offenders who have been convicted of armed robbery and other crimes of violence
and a sex offense are not eligible for parole. Offenders convicted of a crime of violence, including armed robbery, or a sex offense
committed on or prior to August 1, 2014, shall be eligible for parole upon serving 20 years of the term of imprisonment and attaining the
age of 45.
An offender shall be eligible for parole upon serving 15 years if: 1) the person was not eligible for parole at an earlier date; and 2) the
person was sentenced to life imprisonment without parole, probation, suspension of sentence after being convicted of a third or
subsequent felony offense under the habitual offender law. However, this provision will not apply to: 1) a person whose instant conviction
is a crime of violence; 2) the instant conviction or prior conviction is both a crime of violence and a sex offense; 3) the person would still
qualify for a sentence of life imprisonment without parole, probation, or suspension of sentence as a third or subsequent offense under the
habitual offender law.

EXPENDITURE EXPLANATION
There may be an indeterminable decrease to SGF expenditures for the Department of Public Safety & Corrections -
Corrections Services (DPS&C) as a result of allowing offenders convicted of a crime of violence, including armed robbery, or
a sex offense to be eligible for parole; and as a result of allowing other offenders to be eligible for parole upon serving 15
years. The exact fiscal impact of this legislation is indeterminable; however, the expansion of the types of offenders now
eligible for parole or eligible for parole at an earlier date, may result in offenders being released from the custody of DPS&C
earlier than they otherwise would have been.
A reduction in offenders incarcerated could save DPS&C $22.98* per day per offender and $8,388 annually per offender
($22.98 per day per offender x 365 days) for those in adult local housing; and $63.95 per day per offender and $23,342
annually per offender ($63.95 per day per offender x 365 days) for those in a state facility.
*Note: $26.39 per offender per day - $3.41 probation/parole daily supervision daily rate = $22.98 (local housing)
$67.36 per offender per day - $3.41 probation/parole daily supervision daily rate = $63.95 (state facility)
REVENUE EXPLANATION
There may be an indeterminable increase in self-generated revenue to the Department of Public Safety & Corrections - Adult
Probation and Parole (probation) to the extent offenders convicted of armed robbery are released on parole and/or
probation. The probation department would realize an increase in fees paid by parolees and probationers. The exact fiscal
impact is indeterminable because the number of offenders who may be released and the amount of monthly fees charged is
unknown.
