Abstract: Adds aggravated battery committed with a firearm to the list of crimes for which the
legislature is authorized to exempt from special juvenile procedures.
Present constitution provides that the determination of guilt or innocence, the detention, and the
custody of a person who is alleged to have committed a crime prior to his 17th birthday shall be
pursuant to special juvenile procedures which shall be provided by law.
Present constitution further authorizes the legislature to provide, by two-thirds vote of the elected
members of each house, that special juvenile procedures shall not apply to juveniles arrested for
having committed certain offenses including but not limited to first degree murder, second degree
murder, a second or subsequent offense aggravated battery, or a second or subsequent offense of
aggravated burglary.
Proposed constitution amends the present constitution to add aggravated battery committed with a
firearm to the list of offenses for which the legislature is authorized to exempt, by two-thirds vote
of the elected members of each house, from special juvenile procedures.
Provides for submission of the proposed amendment to the voters at the statewide election to be held
November 8, 2022.
