Provides relative to emergency service plans of certain providers. (gov sig) (2/3-CA7s2.1(A)) (Items #2 and #38)
Proposed legislation requires cable service providers and video service providers, on or before 6/1/21, to annually prepare
and submit an emergency service plan to the Public Service Commission (PSC) to include a provider’s emergency
preparedness and response plan to an emergency or disaster. Providers are also required to review their plan on an annual
basis and any revisions to the plan shall be submitted to the PSC before the following June 1st. The PSC is required to
review the plan to determine compliance and shall certify a provider’s compliance or noncompliance to the director of the
Governor’s Office of Homeland Security and Emergency Preparedness (GOHSEP), the Senate Committee on Commerce,
Consumer Protection, and International Affairs, and the House Committee on Commerce. Any provider not in compliance
with this section shall be subject to a civil fine not to exceed $1,000 for the first violation and not to exceed $5,000 for any
subsequent violations. Effective December 1, 2020.

EXPENDITURE EXPLANATION
There is no anticipated direct material effect on the expenditures of the Public Service Commission as a result of the
proposed legislation. The proposed requirements of the PSC can be absorbed within their current operating budget.
REVENUE EXPLANATION
There may be an increase in revenues to the PSC to the extent that any cable service and/or video service provider is found
to be in violation of the proposed legislation and is assessed a fine. The fine for a first violation is not to exceeed $1,000 and
any fines subsequent violations may not exceed $5,000.
