Provides relative to the availability of certain criminal justice system data to certain nonprofit entities (Item #63)
Proposed law is relative to the duty and authority of the Louisiana Bureau of Criminal Identification and Information to
cooperate with certain nonprofit entities; to provide for the authority of certain nonprofit entities to obtain access to certain
criminal justice system data and information under certain conditions; to provide relative to the nonprofit entities’ access to
de-identified arrest and conviction information; to provide relative to the execution of a nondisclosure agreement; to provide
for a termination date of August 1, 2022; to provide for an effective date; and to provide for related matters.
Proposed law provides if enacted the effective date is upon signature by the governor or, if not signed by the governor, upon
expiration of the time for bills to become law without signature by the governor, as provided by Article III, Section 18 of the
Constitution of Louisiana. If vetoed by the governor and subsequently approved by the legislature, this Act shall become
effective on the day following such approval.

EXPENDITURE EXPLANATION
Proposed law will result in an increase in SGF expenditures for the Department of Public Safety and Corrections - Public
Safety Services for the sole purpose of assisting with the study and evaluation of the creation and implementation of a
procedure for automated criminal history record clearing in Louisiana. The bureau may provide limited access to de-identified
arrest and conviction information contained within the bureau's criminal history records and identification files to nonprofit
partners providing technical assistance to the Clean Slate Task Force established by House Resolution No. 67 of the 2020
Regular Session of the Legislature. The bureau shall determine the scope of the limited access to the de-identified arrest and
conviction information provided to the nonprofit. To accomplish this task, Public Safety Services reports a one-time overtime
cost for two Criminal Records Analysts to review the information before releasing it (160 hours, for a total of $4,000), as
well as a one-time vendor (Kologik) cost of $50,000 to provide de-identified arrest and conviction information. A portion of
the estimated $54,000 cost may occur in FY22, as the provisions of proposal law sunset on August 1, 2022.
REVENUE EXPLANATION
There is no anticipated direct material effect on governmental revenues as a result of this measure.
