Creates the Louisiana Opioid Settlement Fund (Item #11)
Proposed legislation creates the Louisiana Opioid Settlement Fund. Requires that all monies received by the state from any
judgment, settlement, or civil or criminal penalty against any manufacturer or responsible party in connection with the
manufacturing, marketing, distribution or sale of opioids shall be deposited into the fund. Provides for the uses of monies
exclusively for improving access to certain medications; supporting behavioral health services providers and referral
treatment services; increasing access to medications that support recovery; expanding access to crisis identification and
stabilization services; expanding and establishing safe stations; organizing primary and secondary school education
campaigns; enforcing laws regarding opioid prescriptions and sales; research and training for substance use treatment and
overdose prevention; and supporting and expanding evidence based interventions. Requires the Governor in consultation
with the Attorney General and the Legislature to develop a plan for the allocation of monies; requires the Governor to submit
such plan to the Joint Legislative Committee on the Budget for approval no later than January 1, 2021.

EXPENDITURE EXPLANATION
There is no anticipated impact to the Governor’s Office, the Attorney General, and the Legislature to develop a plan for the
allocation of monies. There is an indeterminable impact to expenditures of state and local governmental entities as a result
of the creation of the Louisiana Opioid Settlement Fund. While the proposed legislation provides for the uses of the fund, it
is unknown who potential recipients would be. Therefore, expenditure impacts cannot be estimated.
REVENUE EXPLANATION
There is no immediate impact to revenues of state as a result of the creation of the Louisiana Opioid Settlement Fund. The
Attorney General has indicated there is ongoing litigation, as well as negotiations with multiple pharmaceutical
manufacturers involving all 50 states, as well as local governments and municipalities. Many of these have been ongoing for
a number of years; as such the AG is unable to quantify the amount and timing of potential receipts as a result of any
settlement.
