ACT 6 (HB 29) 2020 First Extraordinary Session Zeringue
Appropriates supplemental funding and provides for means of financing substitutions and
other budgetary adjustments for Fiscal Year 2019-2020. Provides for net increases
(decreases) as follows: Interagency Transfers by $2,681,354; Fees and Self-generated
Revenues by ($100,000); and Federal Funds by $4,695,424.
Additionally appropriates $800,124 of State General Fund (Direct) of nonrecurring revenue
out of the surplus from Fiscal Year 2018-2019 for Miscellaneous Non-state Capital Outlay
for the Jeanerette Sewer Treatment Plant Upgrade.
Increases appropriations from Federal Funds in the Executive Department by $2,712,924 in
the Division of Administration and by $700,000 for the Governor's Office of Homeland
Security and Emergency Preparedness.
Increases appropriations from Federal Funds by $500,000 and decreases the appropriation
from Fees and Self-generated Revenues by ($100,000) for the Department of Veterans
Affairs.
Decreases the appropriation from State General Fund (Direct) by ($6,227,152) for the
Department of State and transfers that same amount from State General Fund (Direct) to the
Voting Technology Fund.
Increases appropriations from Interagency Transfers by $405,000 for the Department of
Justice.
Increases appropriations from Interagency Transfers by $1,576,354 for Corrections Services
from Local Housing of Adult Offenders - Criminal Justice Reinvestment Initiative.
Decreases the appropriation from State General Fund (Direct) by ($51,031,316) for the
Louisiana Department of Health and transfers that same amount from State General Fund
(Direct) to the Louisiana Medical Assistance Trust Fund.
Increases appropriations out of Federal Funds by $782,500 for the Louisiana Department of
Health, Office of Aging and Adult Services.
Increases appropriations from Interagency Transfers by $700,000 for the LSU System for the
Pennington Biomedical Research Center.
Increases appropriations from State General Fund (Direct) by $690,000 for the LCTCS
System for accreditation expenses at Northshore Technical Community College, Central
Louisiana Technical Community College, and Northwest Louisiana Technical Community
College.
Decreases the appropriation from State General Fund (Direct) by ($690,000) for Higher
Education - Debt Service and Maintenance.
Adds an appropriation for Miscellaneous Non-State Capital Outlay for the Lafayette Loop
Project funded by $6,500,000 of General Obligation Bonds.
Effective upon signature of governor or lapse of time for gubernatorial action (July 1, 2020).
VETO MESSAGE: "Please be advised that I have signed House Bill 29 of the First
Extraordinary Session with one line item veto. I have vetoed lines 1-9 on page 5 of the bill.
My only line item veto of House Bill 29 is to remove language which deems late-filed capital
outlay projects to be timely filed if the project request was received by June 30, 2020. This
language is an effort to have projects considered to be requested timely even if they are not
in compliance with La. R.S. 39:101. As this is a change to substantive law, this provision
should not be included in an appropriation bill and it may be vetoed pursuant to the
limitations on appropriations bills found in Article 3, Section 16(C) of the Louisiana
Constitution. Further, and just as importantly, while the Legislature worked diligently with
my administration to right size the capital outlay budget and to keep the projects in the
capital outlay program under capacity, some of the late-added projects in House Bill 2 will
cause the program to be over capacity. Thus, several of the late-added projects may not be
able to be funded so as to keep the program under capacity. It is important to note that the
two capital outlay projects in House Bill 29 are not late projects as they were properly and
timely requested."
