Provides relative to the waiver of certain court costs and fees
Present law provides that in juvenile cases the court may waive court costs and fees to the extent that a party is unable to
pay such costs and fees due to poverty or lack of means. Proposed law adds “or for any other reason determined by the
court.”

EXPENDITURE EXPLANATION
There is no anticipated direct material effect on governmental expenditures as a result of this measure. While proposed law
does not directly impact state or local governmental expenditures, it does potentially eliminate fee revenues used to support
certain functions within multiple agencies such as the supreme court, the juvenile court, clerks of court, public defender
offices, district attorney offices and local governing authorities.
NOTE: To the extent that any impacted agencies are to continue operating at current activity levels, local agencies may
require local governing authorities to supplant any loss of funds from general operating revenues or another source if such
loss should be material. The potential impact on revenues used to support agency activities is unknown and not expected to
be significant within any single entity. Any impact will be predicated upon decisions made by the juvenile court to waive
court costs and fees for some reason other than poverty or lack of means and the frequency of such decisions is
indeterminable.
REVENUE EXPLANATION
Proposed law may result in an indeterminable decrease of Local Funds revenues collected through the imposition of court
costs and fees in juvenile courts. Present law provides that in juvenile cases the court may waive court costs and fees to the
extent that a party is unable to pay such costs and fees due to poverty or lack of means. Proposed law adds “or for any
other reason determined by the court.”
To the extent that any juvenile court exercises its discretion to waive court costs and fees for some reason other than
poverty or lack of means, there will be a corresponding loss of revenues collected and remitted to various entities. Court
costs and fees vary by judicial district and generally may be remitted to all or some combination of the following entities: the
supreme court, the juvenile court, clerks of court, public defender offices, district attorney offices and local governing
authorities. The frequency such a decision will be made pursuant to proposed law is unknown and the impact on revenues is
indeterminable but not expected to be significant for any single entity receiving a portion of court costs and fees.
