Establishes a driver's license designation for individuals with autism
Proposed law authorizes an applicant for a driver's license who has autism spectrum disorder to request a designation placed
on their driver's license. Proposed law prohibits an additional fee for the designation. Proposed law requires that applicants
must provide a sworn statement from a qualified medical professional at the initial application and upon renewal. Proposed
law specifies that any person that willfully and falsely obtain the autism spectrum disorder designation shall be fined
between $100-$250, imprisonment up to 30 days, or both. Under proposed law, any subsequent offense by that person
shall result in a fine between $250-$500, imprisonment up to 90 days, or both. Also, proposed law requires the Department
of Public Safety and Corrections, Public Safety Services to establish and implement a law enforcement training course on law
enforcement officers’ interaction with persons with autism spectrum disorder and provides for specific instruction that shall
be included in the course.

EXPENDITURE EXPLANATION
Proposed law will create a one-time expenditure impact of $75,000 (assumed in this fiscal note to be SGF) for the
Department of Public Safety (DPS), Office of Motor Vehicles (OMV) for a professional services contract with the driver’s
license vendor to make changes to the driver’s license format in order to incorporate the new autism spectrum disorder
designation.
Proposed law may create a minimal expenditure impact to OMV associated with coding changes to the Legacy Driver’s
License and Driver Management systems to establish the autism spectrum disorder designation; a nominal workload
increase in the Office of State Police related to developing a training course; and an increase in Local Funds expenditures if a
person is convicted of willfully and falsely obtaining an autism spectrum disorder designation and imprisoned up to 30 days.
Proposed law establishes an autism spectrum disorder designation for a personal driver’s license.
DPS estimates the one-time SGF cost of the proposed law at $12,986 to make coding changes. The Office of Technology
Services (OTS) would perform this work at an estimated 160 hours of overtime by an IT Management Consultant Developer
(160 hours x $80 per hour = $12,800 x 1.45% Medicare tax = $186; Total of $12,986). The LFO believes that any
additional IT work associated with this legislation will be incremental in nature and the department can potentially
accomplish these tasks utilizing existing resources and budget authority. To the extent that numerous pieces of legislation
are enacted that require additional programming efforts, the department may require additional resources.
Proposed law requires DPS to establish and implement a training course with certain criteria relative to the interaction
between law enforcement officers and people with autism spectrum disorder. DPS reports that State Police will incorporate
training under this measure into regular in-service training held for State Troopers utilizing existing personnel and budgetary
resources.
Under proposed law, if a person willfully and falsely presents qualifications to obtain an autism spectrum disorder
designation, that person may be imprisoned up to 30 days. The exact fiscal impact of the passage of this legislation is
indeterminable since it is not known how many people will be convicted of this crime. An offender sentenced to
imprisonment up to 30 days will result in an indeterminable increase in Local Funds expenditures for costs associated with
local incarceration.
REVENUE EXPLANATION
Proposed law may result in an increase in Local Funds revenue as a result of civil fines. Proposed law provides that any
person that willfully and falsely obtains the autism spectrum disorder designation shall be fined between $100-$250,
imprisoned up to 30 days, or both. Because the number of persons who may be fined for willfully and falsely obtaining an
autism spectrum disorder designation is unknown, revenue derived from this source is indeterminable. However, in the
event fines are levied, they would accrue to local governing authorities.
