SUBJECT: Fiscal Note for SB 557 by Senate Committee on Federal and State Affairs
In accordance with KSA 75-3715a, the following fiscal note concerning SB 557 is
respectfully submitted to your committee.
Under current law, professional employees of a school district have the right to form, join,
or assist employees’ organizations to participate in professional negotiations with local boards of
education. SB 557 would give professional employees the right to immediately cease the
withholding of employees’ organization dues from their wages at any time upon the submission
of a written or emailed request to the local board of education. Upon receipt of a request, the local
board of education would cease any withholding of dues for the professional employees’
organization from the employee’s wages, and no further debt to the professional employees’
organization would accrue. The right to immediately resign from and end any financial obligation
to a professional employees’ organization could not be waived.
The enactment of SB 557 would have no fiscal effect for the state. The Kansas Association
of School Boards (KASB) indicates that the enactment of the bill could require clerical and
recordkeeping entries by school district staff. However, KASB estimates that no additional costs
to school districts would occur for these entries. KASB notes that if an employee would remove
authorization for payment of dues during a pay period, the employee would have to seek a refund
for partial payments from the employee organization.
