Dear Representative Waymaster:
SUBJECT: Fiscal Note for HB 2468 by House Committee on Appropriations
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2468 is
respectfully submitted to your committee.
HB 2468 would require the Adjutant General to appoint an Incident Commander for
weather-related disasters within 24 hours after a weather-related emergency declaration is made
by the Governor. The Incident Commander would coordinate with the Kansas Division of
Emergency Management (KDEM) to apply for and administer all Federal Emergency
Management Grants as well as any other state and federal grants or resources related to such
emergency. The KDEM would be required to cooperate with the Incident Commander. During
the emergency, county emergency managers in the affected counties would make requests for
moneys and resources to the Incident Commander, who would coordinate with the KDEM to
disseminate the requests. The KDEM would lead and coordinate all state resources, working with
the State Fire Marshal, the Kansas Forest Service, and any other state agency necessary to respond
to the emergency.
After the state disaster emergency proclamation is terminated, the KDEM would continue
to work with the Incident Commander to continue to apply for and administer state and federal
resources. If requested by the Incident Commander or any county emergency manager, the Office
of Recovery in the Governor’s Department, or any other state agency as appointed by the Governor
if such office no longer exists, would work with the affected counties to provide workshops,
seminars, and conferences for the public to assist with insurance claims and provide information
on monies, resources, and benefits available. The Governor would ensure that the Office of
Recovery, or any other state agency as appointed by the Governor if such office no longer exists,
coordinates with state agencies to provide information and assistance to the residents in the
affected counties.

The bill would establish the Disaster Contingency Fund that would be used by the State
Finance Council to match grants and appropriated funds under any federal act or from any other
source to address the disaster declaration by the Governor. On July 1, 2023, the Director of
Accounts and Reports would transfer $10.0 million from the State General Fund to the Disaster
Contingency Fund. If the unencumbered balance in the fund is insufficient to pay an amount
approved by the State Finance Council, the Director of Accounts and Reports would transfer the
amount equal to the insufficient amount from the State General Fund into the Disaster Contingency
Fund. The total of all amounts transferred from the State General Fund into the Disaster
Contingency Fund would not exceed $10.0 million in any fiscal year. The bill would prohibit
expenditures or obligations from the Disaster Contingency Fund without approval from the State
Finance Council.

The Adjutant General (TAG) recommends that an Office of Recovery within the Kansas
Department of Emergency Management (KDEM) be established to meet the requirements of the
bill. Within the Office of Recovery, the TAG would require 49.00 new FTE positions, 40 new
vehicles and information technology equipment for the new staff at a total cost of $6,110,000 from
the State General Fund in FY 2024. The estimate includes three teams of 4.00 FTE positions, for
a total of 12.00 new FTE positions at a cost of $1,080,000 for salaries and wages. One team would
be responsible for workshops, seminars, and conferences. The second team would be responsible
for assisting with insurance claims and the third team would assist in informing residents of
moneys, resources, and available benefits.
The TAG indicates that only a State Coordinating Officer can work with the Federal
Emergency Management Agency for disaster grants and resources. The bill requires the Incident
Commander to work with the KDEM for this purpose. Therefore, the TAG would require 2.00
State Coordinating Officers at a cost of $180,000 for salaries and wages. Because the bill requires
the TAG to appoint an Incident Commander, the TAG must ensure that counties have qualified
Incident Commanders. For that reason, the TAG would require 35.00 FTE Training Coordinator
positions at a cost of $3,150,000 for salaries and wages. These positions would be spread across
the state to ensure all counties have a fully trained Incident Commander. Each Training
Coordinator would cover approximately three counties. The estimated costs for 40 new vehicles
and information technology equipment are $1.7 million. The TAG notes that subsequent years for
ongoing cost would be $4,410,000 with an additional $1.7 million from the State General Fund
every five years for vehicle and equipment replacement and upgrades.

The Kansas Department of Health and Environment, Kansas Department of
Transportation, State Fire Marshal, Office of the Governor, and Kansas State University state that
the bill would not have a fiscal effect. Any fiscal effect associated with HB 2468 is not reflected
in The FY 2024 Governor’s Budget Report.
The Kansas Association of Counties states that the bill could provide more matching
dollars for counties affected by weather-related disasters. However, a fiscal effect cannot be
estimated.
