SUPPLEMENTAL NOTE ON SENATE BILL NO. 307

Brief*
SB 307 would amend the Kansas Fights Addiction Act
(Act) to include for-profit private entities in the definition of
“qualified applicant.”
Under continuing law, the Act allows qualified applicants
to apply for grants from the Kansas Fights Addiction Fund for
projects and activities that prevent, reduce, treat, or mitigate
the effects of substance abuse and addiction. These grant
applications must be approved by the Kansas Fights
Addiction Grant Review Board.

Background
The bill was introduced by the Senate Committee on
Ways and Means at the request of Senator Claeys.

Senate Committee on Ways and Means
In the Senate Committee hearing on March 21, 2023,
proponent testimony was provided by a representative of the
Office of the Attorney General. The proponent stated the bill
would not risk disturbing existing settlement agreements or
endanger the State’s ability to recover opioid settlement
funds, and the bill would expand the potential impact of the
opioid settlement funds, eliminating certain unnecessary

overhead spending in implementing scientifically proven
abatement strategies.
Written-only proponent testimony was provided by the
Chairperson of the Kansas Fights Addiction Grant Review
Board and by representatives of Acadia Healthcare Company
and the Behavioral Health Association of Kansas.
Opponent testimony was provided by a member of the
public. The opponent stated the bill could lead to services for
substance abuse or addiction to substances outside of
opioids and/or outside of diagnosable substance use
disorders contained in the Diagnostic and Statistical Manual
of Mental Disorders. The opponent also discussed the
concept and effect of patient brokering and regulatory issues
for homes and addiction treatment providers.
No other testimony was provided.

House Committee on Appropriations
In the House Committee hearing on January 30, 2024,
proponent testimony was provided by a representative
Acadia Healthcare Company. The proponent stated the bill
would allow for the expansion of treatment and access to
care for Kansans.
Written-only opponent testimony was provided by a
member of the public.
No other testimony was provided.
The House Committee amended the bill to:
● Add language authorizing members of the Kansas
Fights Addiction Grant Review Board to be paid
subsistence allowances, mileage, and other
expenses when attending meetings of the board
after January 8, 2024; and

● Make technical changes.
Fiscal Information
According to the fiscal note prepared by the Division of
the Budget on the bill, as introduced, the Office of the
Attorney General states the bill would increase the number of
potential recipients of grants awarded by the Kansas Fights
Addiction Act Grant Review Board, and the bill would not
have a fiscal effect on the agency.
The Kansas Department of Health and Environment, the
Department of Corrections, the Department for Aging and
Disability Services, and the State Board of Pharmacy state
the bill would have no fiscal effect.
Any fiscal effect associated with enactment of the bill is
not reflected in The FY 2024 Governor’s Budget Report.
