Dear Representative Patton:
SUBJECT: Fiscal Note for HB 2383 by House Committee on Judiciary
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2383 is
respectfully submitted to your committee.
HB 2383 would specify that the Supreme Court, upon request, would be required to allow
a person who has held the position of a municipal judge in any city in Kansas for a period of not
less than ten years to take the examination given to district magistrate judges. The results of the
examination would have no effect on the person’s eligibility to hold the position of municipal
judge.
The Office of Judicial Administration states enactment of the bill would have a fiscal effect
on the operations of the Judicial Branch. The Office estimates the bill’s provisions would require
the Judicial Branch to hire an additional Court Program Analyst FTE position. The additional FTE
would schedule and organize the place and time to administer the examinations, administer the
actual examination, and track the examination. The estimated cost for the additional FTE position
would be $99,500 from the State General Fund in FY 2024. The Office also estimates there would
be additional costs for other operating expenditures to administer the examinations, which would
include travel expenses, rental of a meeting space, and other miscellaneous expenses. According
to the Office, an accurate fiscal effect cannot be estimated until the Judicial Branch has had an
opportunity to operate under the bill’s provisions. Any fiscal effect associated with HB 2383 is
not reflected in The FY 2024 Governor’s Budget Report.

The League of Kansas Municipalities states enactment of the bill would not have a fiscal
effect on Kansas cities.
