SUBJECT: Fiscal Note for HB 2377 by House Committee on Child Welfare and Foster
Care
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2377 is
respectfully submitted to your committee.
HB 2377 would require the Office of Vital Statistics to waive fees on birth and death
certificates ordered by the Department for Children and Families and the court related to a child
in need of care proceedings.
The Kansas Department of Health and Environment (KDHE) indicates that HB 2377 would
have a fiscal effect of annual loss of revenue of $98,160. The Department for Children and
Families (DCF) indicates that the bill would result in a reduction of expenditures of less than
$2,500 annually. The Division of the Budget notes that the KDHE estimate for lost revenue is
based on historical data for all DCF requests for birth and death certificates. DCF’s interpretation
of the bill is that the fees for certificates would be waived only in child in need of care cases.
The Office of Judicial Administration indicates that the bill would not have a fiscal effect
on expenditures but would have a fiscal effect on revenues to the Judicial Branch. The Judicial
Branch receives a portion of fees for birth certificate copies. If there is no fee charged for birth
certificate copies in these cases, it would result in a decrease in revenue. Any fiscal effect
associated with HB 2377 is not reflected in The FY 2024 Governor’s Budget Report.
