Dear Senator Warren:
SUBJECT: Fiscal Note for SB 100 by Senate Committee on Federal and State Affairs
In accordance with KSA 75-3715a, the following fiscal note concerning SB 100 is
respectfully submitted to your committee.
SB 100 would allow a foreign national or foreign business entity to sell real property in
Kansas that was acquired prior to July 1, 2023, but would prohibit the sale of the real property to
a foreign national or foreign business entity. The Attorney General would investigate the sale of
real property if there were a reason to believe that the transaction violates the provisions of the
bill. Violations would be a severity level 10, nonperson felony. Real property that is sold and
violates the provisions of the bill would be subject to forfeiture. The provisions of the bill would
not apply to property located in Johnson, Sedgwick, Shawnee, or Wyandotte counties.
The Office of Judicial Administration states that the bill could increase the number of cases
filed in district courts because it creates a new crime which would increase the time spent by
district court judicial and nonjudicial personnel processing, researching, and hearing cases. Since
the bill creates a severity level 10, nonperson felony then there could be additional supervision of
offenders. The enactment of the bill could increase the collection of docket fees, fines, and
supervision fees. However, a fiscal effect cannot be estimated because the number of additional
cases is unknown.
The Kansas Sentencing Commission estimates that enactment of SB 100 could have an
effect on prison admissions and bed space, but the effect cannot be determined at this time. The
Kansas Department of Corrections states that the bill would not have a fiscal effect. The Office of
the Attorney General states that enactment of the bill would not require additional staff to

administer the bill, and any additional expenditures generated by the bill would be absorbed within
existing resources. Any fiscal effect associated with SB 100 is not reflected in The FY 2024
Governor’s Budget Report.
