SUBJECT: Fiscal Note for SB 78 by Senate Committee on Utilities
In accordance with KSA 75-3715a, the following fiscal note concerning SB 78 is
respectfully submitted to your committee.
SB 78 would require the Kansas Corporation Commission to evaluate three additional
criteria during electric utility rate case proceedings: regional competitiveness of the utility’s rates,
rate affordability, and the impact of such rates upon the state’s economic development efforts.

Electric utility rate cases are filed approximately every three years. The Citizen’s Utility
Ratepayer Board anticipates that two cases would be filed in FY 2023 and that these cases would
last into FY 2024. The agency estimates that enactment of SB 78 would result in $25,000 of
additional expenditures from the agency fee fund in FY 2023 and FY 2024 and $25,000 of
additional expenditures per rate case in future years. These expenditures would be used to retain
expert consultants to evaluate rate cases on the new criteria relating to rate competitiveness. Fee
fund assessments would be made to the pertinent electric utility to recover those expenses.

The Kansas Corporation Commission indicates that enactment of SB 78 would not have a
fiscal effect on the agency. Any fiscal effect associated with SB 78 is not reflected in The FY 2024
Governor’s Budget Report.
