Dear Representative Owens:
SUBJECT: Fiscal Note for HB 2128 by House Committee on Judiciary
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2128 is
respectfully submitted to your committee.
HB 2128 would create definitions of “intimate partner” and “intimate partner violence” in
the Kansas Criminal Code. The bill would also specify that if a defendant is charged with a crime
and the alleged victim of the crime is a person who is an intimate partner of the offender, when
setting the amount of an appearance bond and conditions of release, the magistrate would have to
consider the following:
1. The safety of the alleged victim, the victim’s children, and any other person who may be
in danger if the defendant is released;
2. Information related to prior arrests for intimate partner violence and other offenses,
including arrests involving any victim; and
3. Any current or prior protective order that has been issued against the defendant.
The Office of Judicial Administration indicates enactment of HB 2128 would have a
negligible fiscal effect on the operations of the Judicial Branch.
