Dear Senator Billinger:
SUBJECT: Fiscal Note for SB 35 by Senate Committee on Federal and State Affairs
In accordance with KSA 75-3715a, the following fiscal note concerning SB 35 is
respectfully submitted to your committee.
SB 35 would change current law regarding pay for legislators for service at regular or
special sessions of the Legislature, as well as for interim committee meetings when the Legislature
is not in session. The bill would increase pay from $88.66 per day to $125.00 per day and would
increase expense allowances from $354.15 per pay period to $554.15 per pay period. The bill
would become effective July 1, 2023.

According to Legislative Administrative Services (LAS), the enactment of SB 35 would
increase annual expenditures for the Legislature and the Legislative Coordinating Council budgets.
For the Legislature’s budget, a typical 90-day session was used to estimate additional costs for
salaries for 165 legislators. The additional costs for a 90-day session would include $659,543 for
salaries and wages (going from $88.66 per day to $125.00 per day) and $806,632 for legislative
allowances (going from $354.15 per pay period to $554.15 per pay period).

Additional expenditures would be incurred with interim committee meetings and
legislative duties. LAS estimates the additional cost for legislative salaries for interim committees
would total $52,541, using an average of 91 committee days with 13 legislators. For legislative
duties (additional duties and leadership expenses), LAS estimates the additional cost would total
$5,774.
For the Legislative Coordinating Council, LAS estimates additional annual costs for 12
meetings for eight legislators’ salaries and wages at $4,264 (going from $88.66 per day to $125
per day).
All cost estimates include employer-paid fringe benefit costs of 22.2 percent and would be
financed from the State General Fund. Any fiscal effect associated with SB 35 is not reflected in
The FY 2024 Governor’s Budget Report.
