Dear Representative Williams:
SUBJECT: Fiscal Note for HB 2513 by House Committee on K-12 Education Budget
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2513 is
respectfully submitted to your committee.
HB 2513 would prohibit a test, questionnaire, survey, or examination containing any
questions about personal and private attitudes, values, beliefs, or practices of a student or the
student’s family, guardians, family members, associates, friends, or peers for any student in
kindergarten through grade 12. However, a questioning instrument could be given if the parent or
guardian of the student is notified not more than four months in advance of the administration of
the questioning instrument. The bill would outline requirements of the notification to the parent
or guardian. The parent or guardian would be required to give consent through a written or
electronic signature and the consent could be only accepted after a parent or guardian has received
the notification and had an opportunity to review the information. The bill would require written
consent separately for each administration of questioning instrument.
Prior to the administration of an affected questioning instrument, a student would have the
right to refuse to take the instrument at any time without limitation or suffer any adverse
consequences with a refusal. In addition, each school district would be required to post and
maintain a copy of each questioning instrument on the school district’s website, as required by the
bill. No instrument would be allowed to be incorporated into any academic program, course, or
curriculum offered by a school district or any personally identifiable student data could be
collected.

According to the Department of Education, the enactment of HB 2513 would have no fiscal
effect on state aid to school districts; however, the agency notes that there would be additional
administrative costs for local school districts, but these additional costs cannot be estimated.
