SUBJECT: Fiscal Note for SB 297 by Senate Committee on Assessment and Taxation
In accordance with KSA 75-3715a, the following fiscal note concerning SB 297 is
respectfully submitted to your committee.
SB 297 would amend existing law concerning contracts and service charges for the
collection and disposal of trash and/or garbage by cities and counties. In the case where this service
is not a municipal function and is provided by contract, the bill would increase the limit of the
contract from not more than ten years to not more than 20 years and remove limitations currently
applicable to cities of the first class having the commission form of government. The bill would
remove the language in current law that allows garbage which can be disposed of through a sewage
disposal plant to be disposed of in this manner rather than by burning, burying, feeding or other
means of disposal. The bill would specify that no service charge could be levied against vacant
lots or other vacant property and would remove a county’s ability to collect annual fees on the ad
valorem tax statement. The bill also makes a number of technical corrections.
According to the League of Kansas Municipalities, enactment of SB 297 would result in
reduced revenue for the cities of Kansas as it would remove the option to add fees to the ad valorem
tax statement and the option to implement monthly billing and collection on vacant property. The
Kansas Association of Counties indicates that enactment of the bill would require a separate billing
and collection process for trash which could result in some cost to the counties; however, the
Association is unable to estimate what that cost might amount to.
