SUBJECT: Fiscal Note for SB 292 by Senate Committee on Federal and State Affairs
In accordance with KSA 75-3715a, the following fiscal note concerning SB 292 is
respectfully submitted to your committee.
SB 292 would amend existing law concerning advance ballots to specify the requirements
for a person to transmit or deliver an advance voting ballot to a county election officer or polling
place on behalf of a voter other than the person delivering the ballot. In addition, the bill would
prohibit any person from delivering more than five advance ballots on behalf of other voters.
According to the Secretary of State, enactment of SB 292 would have no fiscal effect on
the agency. According to the Office of Judicial Administration, enactment of the bill could
increase the number of cases filed in district courts because it creates a new crime. This, in turn,
would increase the time spent by district court judicial and nonjudicial personnel in processing,
researching, and hearing cases. Since this crime carries a severity level 9, nonperson felony
penalty, there could also be more supervision of offenders required to be performed by court
services officers. In addition, the enactment of the bill could result in the collection of additional
docket fees, supervision fees and fines assessed in those cases filed under the provisions of the
bill; however the fiscal effect on the Judicial Branch cannot be estimated. Any fiscal effect
associated with SB 292 is not reflected in The FY 2022 Governor’s Budget Report.
The Kansas Association of Counties indicates that enactment of SB 292 could cause some
costs for election officials who would need to enforce and monitor the provisions of the bill.
