SUBJECT: Fiscal Note for SB 279 by Senate Committee on Federal and State Affairs
In accordance with KSA 75-3715a, the following fiscal note concerning SB 279 is
respectfully submitted to your committee.
SB 279 would create the Wind Generation Permit and Property Protection Act. The bill
would prohibit construction of a wind turbine facility until the developer enters into a facility
agreement with a landowner that demonstrates that the developer has complied with the
requirements specified in the bill. The bill establishes minimum setback distances for wind
turbines and requires the board of county commissioners in each county to approve an application
for construction of the facility.
The Kansas Corporation Commission does not expect that enactment of SB 279 would
have any fiscal effect on the agency.
The Kansas Association of Counties indicates that enactment of the bill could have a fiscal
effect on counties that host wind generation power facilities as there could be some initial costs
associated with the siting and permitting process. However, the Association states that those costs
could be offset by payments from the facilities.
