Dear Senator Hilderbrand:
SUBJECT: Fiscal Note for SB 274 by Senate Committee on Assessment and Taxation
In accordance with KSA 75-3715a, the following fiscal note concerning SB 274 is
respectfully submitted to your committee.
SB 274 would update the Naturopathic Doctor Licensure Act. The bill would allow for a
naturopathic doctor to order and perform physical examinations, certain orifical examinations,
laboratory examinations, and prescribe, administer or dispense medications. A naturopathic doctor
would also be allowed to order certain diagnostic imaging tests but would have to refer to a
licensed and qualified professional to conduct an interpret the test results. The bill would also
describe other activities a naturopathic doctor could and could not perform. A naturopathic doctor
would be required to maintain records as described in the bill. The bill would also expand the
instances when the Board of Healing Arts could deny, refuse to renew, suspend, revoke, place
under probationary conditions, or limit a license. Finally, the bill would update license renewal
requirements.
As of February 24, 2021, there are 47 licensed naturopathic doctors. The Board of Healing
Arts states that enactment of the bill could lead to an increase in complaints that could be actionable
and lead to an increase in investigations and litigations. However, the agency estimates that the
increase in complaints could be absorbed by existing staff and would not require any additional
funding.

The Office of Judicial Administration states that any additional expenditures created by the
bill would be negligible and absorbed within existing resources. Any fiscal effect associated with
SB 274 is not reflected in The FY 2022 Governor’s Budget Report.
