SUBJECT: Fiscal Note for SB 272 by Senate Committee on Federal and State Affairs
In accordance with KSA 75-3715a, the following fiscal note concerning SB 272 is
respectfully submitted to your committee.
SB 272 would require a urinalysis test in sexual assault kits to determine the presence of
controlled substance that may have been used to commit the alleged sexual assault. The urinalysis
test would only be used to determine presence of controlled substances and would not be
admissible as evidence against the victim in any legal action, criminal or administrative
proceedings.

The Kansas Bureau of Investigation (KBI) indicates that it would require $462,049 from
the State General Fund in FY 2022 to fulfill the requirements of the bill. Of that amount, $67,921
would be for 1.00 Forensic Scientist, $347,500 would be for scientific equipment, and $46,628
would be for sexual assault kits. The KBI also states that enactment of the bill could also require
the purchase of an additional refrigeration or freezer system for storage of the samples; however,
an estimate for this equipment was not given.

The Office of Judicial Administration states that any additional expenditures created by the
bill would be negligible absorbed within existing resources. Any fiscal effect associated with SB
272 is not reflected in The FY 2022 Governor’s Budget Report.
